Employer Sponsored Visa

Employer Sponsored visas form very important part of Australia’s migration program. Employers can sponsor overseas citizens for positions where local Australians are not available. Australia faces skill shortages in many occupations and employers have options available with them to sponsor overseas citizens to fill these gaps. Employers can sponsor skilled professionals for temporary as well as permanent visas. These skilled professionals may be inside or outside of Australia.

Subclass 457 Visa:

It is a temporary visa for duration up to four years. Employers can sponsor skilled people who can nominate an occupation from the ‘Consolidated Skilled Occupation List’ i.e. CSOL.

Three steps in 457 visa program:

  • Employer applies to become a ‘Standard Business Sponsor’
  • Employer applies to nominate the skilled applicant
  • Applicant applies for visa – applicant must meet minimum basic requirements of skill, English, registration and licensing (if applicable).

Visa holder may be eligible for permanent residency of Australia subject to meeting the requirements of a particular permanent visa.

Subclass 187 Visa (Regional Sponsored Migration Scheme also known as RSMS)

It is a permanent visa of Australia. Employers based in regional areas of Australian can sponsor skilled applicants for this visa. Applicants do not have to choose an occupation from any list. Their nominated occupation’s skill level determines if this option is available.

  • Temporary Residence Transition Scheme: It is for subclass 457 visa holders who have worked for two years and their employer wants to offer them a permanent position.
  • Direct Entry Scheme: Applicants may be eligible under this scheme if they hold relevant skill, qualification and work experience. Applicants also need to meet Age, English and other relevant criteria.
  • Agreement Scheme: It is for applicants who are nominated under a labour agreement agreed between employer and immigration.

Subclass 186 Visa (Employer Nomination Scheme also known as ENS)

It is a permanent visa and employers from any part of Australia can sponsor skilled applicants.

Two steps in ENS program:

  • Employer applies to nominate applicant
  • Applicant applies for visa – applicant must meet minimum basic requirements of Age, English, qualification, skill, registration and licensing (if applicable).

Three schemes of ENS visa program:

  • Temporary Residence Transition Scheme:It is for 457 visa holders who have worked for two years in their nominated occupation for their employer.
  • Direct Entry Scheme:Applicants may be eligible under this scheme if they hold relevant skill, qualification and work experience. Applicants also need to meet Age, English and other relevant criteria. Applicants must also nominate an occupation from ‘Consolidated Skilled Occupation List’ i.e. CSOL.
